General Terms and Conditions Eventpark Kaiserlautern GmbH
I. General Terms and Conditions of Use
- The following General Terms and Conditions apply exclusively to the business relationship between Eventpark Kaiserslautern GmbH and the customer.
- The use of the areas provided by Eventpark Kaiserslautern GmbH (including the trampoline area, ninja course, escape rooms, and the toddler area) involves certain risks. Use of the facility is at your own risk. To avoid injury, our general terms and conditions of use must be observed and complied with. These are also posted at the entrances and access points. In addition, the instructions of the staff must be followed. In the event of disregard of the instructions and/or non-compliance with one or more points of the terms and conditions of use, Eventpark Kaiserslautern GmbH reserves the right at any time to expel visitors from the premises, ban them from the premises, and take further steps at its own discretion without any entitlement to a refund of the admission price.
- The customer is entitled to all services made available to all visitors to the fun park on the relevant day. They are not entitled to the complete and uninterrupted operation of all attractions. Operational disruptions or the failure of individual attractions for an entire day do not constitute a defect. If the service is not used during the period of validity of the ticket, the customer is not entitled to a refund of the purchase price or to be granted access on another day.
- Eventpark Kaiserslautern GmbH exercises its domiciliary rights. Eventpark Kaiserslautern GmbH is entitled to issue expulsion orders or bans from the premises or to take other appropriate measures within the scope of its domiciliary rights. Visitors may be expelled in particular if they harass other visitors or have violated the General Terms and Conditions or the rules of use in any other significant way or repeatedly.
- Bringing your own food and drinks is generally not permitted. An exception to this rule is our bookable birthday packages. If you have booked a birthday package, you are permitted to bring your own cake and/or cake pops.
- Every guest who uses the trampoline area and/or the ninja area at Eventpark Kaiserslautern GmbH must be in possession of a valid Jump time band which must be purchased at reception before use. Compliance with this obligation will be checked by our staff. Eventpark Kaiserslautern GmbH reserves the right to claim damages in the event of violations of the rules.
- The change received after payment must be checked immediately for accuracy. Later complaints are not possible.
- The player may withdraw from the booking at any time before the start of the game. The withdrawal must be declared to the operator. If the player withdraws before the start of the game or does not appear for the game, the operator may demand reasonable compensation, the calculation of which usually takes into account any expenses saved and any other possible use. The compensation shall be calculated as follows based on the date of receipt of the player's withdrawal notice: Less than 3 days before the start of play: 50%
- The transfer or assignment of purchased tickets is not permitted.
- Use of the premises is permitted from the age of 3. Children under the age of 7 may only jump under the constant supervision of a known adult. Children under the age of 7 do not yet have sufficient experience to correctly assess their own abilities and do not have the knowledge to recognize dangers in good time. The accompanying person helps the child to minimize the associated higher risk of injury by intervening. Children under the age of 3 should only jump at Minijump in a specially protected environment.
- Guests under the age of 18 require, without exception, a correctly completed and signed form from their legal guardian or an authorized adult. declaration of consent. We only accept consent forms provided on site or on our website; we do not accept letters written by yourself.
- In case of danger, fire, or accident, use the marked emergency exits—the elevator is not an emergency exit.
- The use of the clothing lockers is subject to a deposit. Users are responsible for their own keys. Eventpark Kaiserslautern GmbH is not liable for keys or the deposit for them. We accept no liability for clothing or other items of any kind brought onto the premises, unless the loss was caused by gross negligence or intentional behavior on the part of Eventpark Kaiserslautern GmbH.
II. Use of the jumping facility
- Eventpark Kaiserslautern GmbH shall be liable in accordance with the statutory provisions for damages resulting from injury to life, limb, or health, as well as for damages caused by intent or gross negligence.
- Eventpark Kaiserslautern GmbH shall be liable for other damages resulting from a slightly negligent breach (simple negligence) of essential contractual obligations, limited to compensation for the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose breach jeopardizes the achievement of the purpose of the contract, whose fulfillment is essential for the proper execution of the contract, and on whose compliance the customer regularly relies and may rely. Otherwise, claims for damages by visitors arising directly or indirectly in connection with the use of the trampoline park, regardless of the legal basis, are excluded, unless otherwise specified below.
- Pregnant women, persons with health restrictions, persons who are unable to walk and/or stand independently due to a disability, and persons weighing more than 120 kg are not permitted to jump. Jumping under the influence of alcohol, medication, or drugs is prohibited. The same applies to persons who consume illegal intoxicants within the building. In this case, there is no entitlement to a refund of the admission price already paid. Smoking and alcohol are strictly prohibited in all areas of Funpark Kaiserslautern.
- For safety reasons, head coverings are not permitted on the sports equipment in our parks. They can pose a danger to the guest themselves or to other guests (e.g., accidental entanglement, getting caught, obstructing vision, strangulation, or losing pins). Exceptions apply to head coverings worn for religious reasons, provided they are intended for sporting activities (e.g., sports headscarves) and otherwise meet safety requirements (e.g., no pins, no slipping). Long hair must be tied back in a ponytail.
- All pants and jacket pockets must be emptied before jumping. Jewelry, watches, cell phones, belts with studs, and glasses must also be removed. Items such as balls or other play and sports equipment brought along are prohibited! In addition to damage to personal items, there is also a risk of serious injury, such as torn ears or piercing holes, hard blows to the face, especially the eyes, damage to or broken teeth, fingers getting caught in jewelry or belts with corresponding injuries (bent, broken, or dislocated fingers).
- Leaving clothing, cups, bottles, bags, or other items on the trampoline arena and/or in the access area, escape routes, or at or in front of emergency exit doors is prohibited! This creates tripping hazards and could prevent rescue measures and block escape routes.
- The use of cell phones, cameras, video cameras, action cameras, or similar devices is prohibited throughout the entire jump arena. Violations will result in expulsion from the facility without refund of the admission price! Body cameras are only permitted if worn correctly (securely attached to the body at chest height) and must not pose a danger to the wearer or other jumpers.
- Food and drinks are not permitted anywhere on the trampoline facility. Eating is not permitted during jumping time. This prohibition also applies to chewing gum and other sweets. Your mouth must always be empty, as otherwise there is a risk of serious physical damage or injury, in particular choking on swallowed food. When jumping, make sure that your tongue does not get caught between your teeth, as this can cause painful injuries or tissue loss. You should also make sure that your teeth do not knock together when jumping, so that your teeth are not injured.
- The jumping areas may only be accessed with our jumping socks, which are available for purchase and manufactured specifically for use in our trampoline hall. For safety reasons, gym shoes, sneakers, or standard socks with rubber soles are not permitted. Using the ninja area and trampoline area with short-sleeved shirts and shorts increases the risk of injury and is not recommended, as this can lead to painful abrasions and grazes on the skin when hanging from the ropes and landing on the trampoline surface.
- Only one person is allowed on each trampoline at a time. Otherwise, if more than one person uses the trampoline at the same time, the resulting catapult effect can cause serious and severe injuries, especially from collisions between people, such as lacerations, tooth damage, or skull fractures. Broken bones, paralysis, or similarly serious injuries are also possible if people jump on top of others. For the same reasons, romping around, running, attacking, pushing, or playing tag is not permitted.
- Jumping or performing somersaults or other trick jumps over the covers or from trampoline to trampoline is not permitted. This can result in serious injuries such as ligament and tendon damage, broken bones, skull fractures, spinal injuries, broken necks, paralysis, or death if you land next to or between the trampoline surfaces or on unpadded areas.
- When taking necessary breaks, please leave the trampoline area and do not sit on the trampoline surfaces or covers. Otherwise, collisions with other jumpers may occur.
- Jumping from the jump tower is only permitted alone, not in pairs or groups. Landings should be as wide as possible. Landing on the airbags (landing zone of the jump tower) head or feet first is extremely dangerous. This can result in serious injuries such as concussions, loss of consciousness, facial injuries caused by the recoil of the knees upon impact, or injuries to joints, the spine, and broken bones.
- All athletic tricks and activities are performed at your own risk and should therefore only be performed after carefully assessing your own physical abilities and, of course, without endangering others. Before performing trick jumps or somersaults, the jumper must first familiarize themselves with the trampoline. Trick jumps and somersaults on the trampoline are particularly dangerous, even for experienced jumpers. Please note that this can result in serious and severe injuries, such as facial injuries caused by the recoil of the knees upon impact, as well as injuries to ligaments or tendons. It can also lead to broken bones, skull fractures, spinal injuries, broken necks, and even paraplegia.
- Climbing on the sloping trampoline walls, side walls, and nets is prohibited. Jumping on the side trampolines above 1.30 m (marking) is at your own risk! Jumping from the jump wall onto the trampoline is not permitted due to the high risk of accident. During the entire jumping time, it is essential to be considerate of others and not to endanger them at any time through uncontrolled actions.
- Use of the gladiator beam is at your own risk. The distance to the walking surface is limited to 2 m on each side. Jumping from the gladiator beam into the cube pool is prohibited, and pushing off when falling is also prohibited, as this increases the risk of injury.
- Digging holes or rummaging through the cube pools is not permitted for safety and hygiene reasons. In the event of non-compliance, we reserve the right to charge for any personnel and cleaning costs incurred. Diving into the foam pools head or feet first is extremely dangerous. Landings should be made on as large a surface area as possible. The jump and landing zone must be vacated immediately to avoid collisions with other jumpers, which could result in injury.
- The use of the Wipe-Out (Twister) poses a particular danger. The Twister may only be operated by trained personnel. Manual operation by guests, e.g., by pushing the Twister beams, is not permitted. Even when operated correctly, serious injuries can occur. There is a risk of blows, impacts, or entrapment. When jumping, always stay in the middle of the trampoline. Trampolines must not be left while jumping. Despite the padded covers, jumping onto the frame can lead to serious injuries such as broken bones, concussion, spinal injuries, paralysis, or death. Running from trampoline to trampoline within the Twister is not permitted.
- In the event of an accident, our staff must be informed immediately so that proper documentation can be carried out.
